If you have written to the council and appealed the ticket then the council are duty bound to reply within a certain time frame (not sure what it is mind you). The penalty should be frozen while they are 'considering' your appeal. If they do not respond to your appeal ( if it's rejected then you will receive something that they will tell you is a 'notice of rejection'), then this acts in your favour, because they haven't followed the procedure that they are obliged to. What would happen next is that you receive a notice to owner, asking for the full penalty. At this stage you write back to the council, inform them that that they haven't followed procedure, and that you are taking the appeal to PATAS. Include any other information that you put in your initial appeal. Of course, it will help your case if you have some form of evidence that you submitted an appeal to the council in the first place. |
