In theory, tenancy agreements for street properties with 3 flats will give responsibility for the back garden to those who can access it. If there is side access or a rear staircase and the garden is large enough, it might be sub divided. The front garden ought to be allocated to the gf flat only (for privacy)with access only to bins for upper flats. In practice, the front garden is probably not mentioned on the tenancy agreement and therefore the responsibility of all the tenants (there will be a general clause requiring such)Hence Marie's problem! Marie could ask the HA to undertake the work but if they agreed they could recharge the cost to the service charge (if there is one) This would cost Marie and she might prefer to keep cutting. I have a hedge to my front garden and the time consuming bit is collecting the trimmings. My best suggestion is that Marie suggests her neighbours join in on a hedge trimming day, she cuts, they clean up! Good luck Iain |
