I would be surprised if the council would be bothered by a hedge that overhangs the pavement by only 2 inches. I note that the notice merely says "vegetation". Are you sure it doesn't refer to a tree, perhaps one that is obscuring a nearby traffic sign? Section 154 of the Highways Act 1980 says that if a hedge, tree, shrub etc. overhangs a public highway so as to endanger or obstruct the passage of vehicles or pedestrians, or obstructs or interferes with the view of drivers of vehicles, then the council can demand that within 14 days it is suitably cut or lopped to remove the problem. If the offending vegetation is not cut back within 14 days, the council are entitled to get the job done themselves and to recover the cost "from the person in default". The Act seems to give the council the option of addressing the notice to either the owner of the vegetation or the occupier of the land on which it is growing. How was this card addressed? |
