Luke needs to look at section 1(5)(b), Planning (Listed Buildings and Conservation Areas) Act 1990. The protection and building controls affecting a listed building extend to any object or structure which is fixed to the building, and to any object or structure within the curtilage of the principal listed building if it has formed part of the listed building land since before 1 July 1948. It seems to me, and to the Victorian Society, that since the chimney is listed, then the protection attached to the chimney also attaches to the baths. |
